Ebay help? any sellers ?

Question

I bought a movie on ebay called Elvis and Me. It came out in the 80's and is hard to find.... and expensive for a movie .Anyways I won this item for $45 including shipping. When I got it in the mail I realized all he did was buy an empty dvd case and print out a copy of the original cover to place in the case, the movie was only a copy and he wrote Elvis and Me on the disc. Isn't that illegal!!!! last time I checked it was illegal to copy a movie and sell it. Am I wrong for being really upset at this guy. I paid him a lot of money and he didn't even describe it as a copy. Should I leave him bad feedback?

Not only do I believe it could be illegal (may depend on where you/he lives) I believe it's against the eBay Code of Conduct. I think you should take a look at this (you will prbably be able to find a link to it in the help pages) and, if it is a breach of the code of conduct, you should definitely report him to eBay however it suggests.

If you want to keep the DVD then contact the seller and tell him that you're upset to find out this is a copy and not the original because you paid so much. Maybe he will refund some of your money. Or if you don't want to keep it then you can send it back for a full refund. Buyers are responsible for return delivery charges so you'll have to pay to send it back but a DVD should be very cheap to mail. Get delivery confirmation so he can't say he never received it back. If he doesn't want to do a refund you can file a claim with paypal and he'll have to take it back and possibly face some other problems if it is against the law. It think it is technically illegal to sell copies but people do it all the time on ebay so I'm not surprised to hear it. At the very least he should have specified that this was a copy in his listing. Just explain to him that you wouldn't have bid so high if you knew it wasn't an original. See if he's willing to accomodate you before reporting him or leaving negative feedback.
