Ebay help ke please??????

A friend gave me a pair of Jordans as a gift. I decided i didnt want the shoes so i posted them on ebay. I am not sure if the shoes are 100% authentic and i DIDNT say they were when i listed them on ebay. I posted 4 pictures of the shoe. The person that purchased them got them for $60 and I stated it was a final sale, meaning no refunds. I also encouraged each person to ask questions before bidding and this person didnt.

My question is..can i be held liable by paypal or ebay if the shoes are not authentic?

  1. Yes, if the buyer returns the shoes to you in the condition you sent them to them, then they can file a claim through paypal and get their money back.  As long as the buyer has proof that the shoes were sent back (tracking number), then they can file a claim.  Stating in your auctions: all sales final, no refunds, etc. doesn't help you at all as a seller.  Now ebay won't do anything to you (other than you getting bad feedback for the auction).  Did the buyer complain that the shoes were not authentic?  or are  you just worrying?


  2. I don't think think they could if you never stated they were authentic and he never asked. And if the buyer already doesn't suspect something, I don't think he will find out.

  3. if the buyer did not ask the question, then i don't think that you would be held liable if they aren't authentic. The buyer clearly just wanted to buy the shoes, so if they weren't authentic it it is not your fault for not putting them on, if the buyer wanted to know they should have asked.

Yes you can.  I ran into this problem when I sold a fake fendi purse.  I had listed that it was a fake in the description, but I was contacted by e-bay and informed that as part of my user agreement I had agreed not to sell designer imposter products.  Since you are not allowed to sell fakes on e-bay, a buyer can assume that any product you sell is authentic without you noting it for them.  Sorry!

    Chances are that if you couldn't tell the difference, the person who got them will not be able to tell either.  But if the person does and wants to send them back, it would be a good idea for you to take them back.
