This is an ebay question. ok, so i recently got this message from the man is old my broken video ipod. "I received the ipod I purchased from you, but there is no way this ipod was simply hit with a pool ball as described in your listing. This Ipod was opened up, the logic board has markings on it so it is obvious you knew this was bad. The hard drive is also bad and, while the the LCD is cracked, I could have accepted it as what I really needed was the logic board. I'd like a full refund as you misrepresented what you were selling." I replied "I did not open the ipod up, and it was hit by a pool ball. I do not know how to open it up, and nobody in my family does. It has not been to any shops or anything. I did not list refund as an option, and i did not misrepresent my item. I said it was broken, and i said how it got broken. I did not try to fix it, and i did not open it up. so i dont know what your talking about." I do not think i misrepresented what i put for sale seeing as how i told how it was broken, and said it should be used as parts. I did not know if the parts were good or not because i have not ever opened an ipod, and i dont know how..I think this link will take you to the item http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&ssPageName=STRK:MESOX:IT&item=220262431245 . i guess im wondering if i am legally bound to give him his refund? i do not think i am though.

  1. I can not read your listing since it is has ended so the link is no good.

If you wrote "AS IS. NO refunds. Broken. No idea what parts are good" then NO, he can not get a refund.

He can leave bad feedback though. If he does, just plainly state "Sold broken and that was clearly stated in the listing" IF that is in fact TRUE.

Be honest when you list an item. State always if you offer refunds. State if you know if the item works or if you don't know----state that too!! Good luck.

  2. no you did list it should be bought for parts and nothing more it says its broken so it doesnt matter if its open or not because you listed it as BROKEN so you are mostly correct but the picture isnt so your both right but you shouldnt give him a refund

  3. Hi! I have been selling on Ebay for about 7 years. Right now, I am taking a break. It sounds like you did not mis-represent the item for sale. Someone probably was hoping that it still works. It doesn't sound like you owe them a refund, if it's like you said, you revealed everything about the item, then you did your part. I don't even think Ebay would make you give them a refund, but they might go into Paypal and try to get one, if they paid by Paypal. I doubt you're legally bound to give him a refund. Hope it works out for you!

  4. it does say that the buyer has 7 days to return the item.  It does also say that it is broken. so i dont think he can do anything legally unless it was within those 7 days. and what does he expect a pool table ball is wicked heavy. it doesnt matter if you opened it or not, you said it was broken and he bought it broken, you said that it wouldn't work, and it doesn't.  you didnt give any false hopes what so ever. so dont worry about it. Ask him how it was misrepresented.  Because you can get in trouble for that, but I have no clue what he's talking about.  There's no way for him to prove that the pool ball didn't hit it.  that's ludacris.  good luck!

  5. If you didn't list refund as an option you don't have to refund it because once the person bid on an item is accepting your terms. If the description of the item accurate don't worry just be aware that you're gonna receive negative feedback. Hope this helps.
