Question:

Ebay seller didn´t send me the item.Can I win if I open dispute?

I¨m from Spain and bought a handbag from a private seller in Ebay on the 18th July. Before winning the bid, I asked the seller to include insurance for the bag. She said "It will be on the invoice when I send it if you win".

I paid through Paypal, that´s what I received. She claims she uses Auctiva and that she has no records of me having paid insurance. I never received any invoice or way of payment in relation to Auctiva.

Anyway, when a month has passed, the first thing I do is asking her in relation to the bag. But the first thing she answered was:

"Did you purchase insurance for the bag?"

I´m sure ( due to more several mails where she NEVER says when she shipped my bag ) that she never sent it to me.

Now she "suggests" that I should pay again the shipping and insurance again ( USD 19 ). I don´t agree with that and my question is:

If I opened a dispute, do I have possibilities of winning? Has anyone undergone a situation like this?

  1. i never trusted ebay and never will but you have a good chance olf winning the dispute. but i advise to never use ebay again


  2. You need to get in contact with eBay immediately.  Have you already rated her?  If you haven't, leave a negative comment.  It sounds like it's a fraud, no one would ever have you pay the shipping and insurance twice if they actually sent the thing already.

    This may have happened to someone else, and if that's the case, eBay will cancel her account and possibly take legal action against her.  As for the state of your bag - there might not even be a real bag.  Even if there is, it seems unlikely at this point you will get it, even if eBay gets involved.

  3. It might be faster to file some sort of dispute with Paypal, instead of going to eBay first. I have always heard from bitter sellers who only accept money orders and avoid PayPal saying, "PayPal will ALWAYS side with the customer." I have never been sure of what that means, but I gathered that it was something to the effect that if the buyer complained that they did not receive an item, they would simply have their original payment reversed and returned to them.

  4. You need to file with paypal,once the auction is over and you have paid,ebay will send you to paypal anyhow.There is a time limit for filing a dispute so I would do it immediately.

  5. You tell me where she stays my friend ill get your bag, as the other chap says never trust ebay been ripped off before myself.

Yes....open a dispute against her......You have the proof in the emails that you've just wrote here.....Go to the  ebay live chat ....it will connect you to a person that will help you......Make sure that you write everything the 2 of you have said to each other.....It's very important......They will first tell you to contact the seller and try to work it out between you....Tell them you have....then write what was said ........Don't leave out anything that will help you.....And, Don't Forget to make copies of everything that has been going on...since the first wining bid.....make copies of the live chat that you have with ebay too......Make sure you tell ebay You are making copies of your conversations with them.........It will  be very important.....When your in the dispute case .....make sure you repeat things that she has said....proving her to be the liar she is........Don't Back down for any reason......You have to prove she is responsible......Eaby Will go into her paypal account and take your money and put it back into yours.......Don't give up......The one I went through went for 6 months....but no one is going to dishonor my name......Good Luck
