Ebayer won't ship item from auction I won unless I pay more?

This is a copy of the e-mail I received from a seller whom I purchased a textbook for a class from:

Dear michelel_sells,

I would have like to have sold this for more. I know someone who will buy it for more than you bidded. so unless you can pay more I will not be able to sell it to you.

I've been the top bidder on this book for 6 days and I start class in less than a week and REALLY need a book! Is he allowed to do this to me?

  1. Did the auction end, with you as the high bidder?  If so, he is legally obligated to sell it to you for your winning bid.  Now, most of the time transactions that fail for one reason or another do not end up in court, but perhaps by sending him a message telling him that it is a legally binding contract will help.

    Also, forward the email to eBay.  File a dispute.  This behavior is unacceptable amongst sellers, and he needs to be stopped.

    EDITED TO ADD: I actually contacted this member via his eBay profile and sent a note.  The situation just irritated me.  I hope you get your book!


  2. I don't believe so, if they wanted more they should have started the bidding higher. Contact Ebay if you do not get your item. They are possibly just trying to get money out of you.
