Question:

Economic Stimulus for Amended Tax Return?

By mistake I filed my 2007 tax return as Single though I was married late last year. I have already received the $600 Economic Stimulus but now I want to file an amended return as Married Filing Jointly so that I can get additional tax refund. Now my question is how do I claim the additional $600 of the Economic Stimulus package as Married people are eligible for $1200.

Thanks,

ITIN

  1. The IRS will know what they sent you and even though they make mistakes they will more than likely just send you the difference. You do not have to put anything about the stimulus on the amended return. Now if your wife has already filed her taxes also and she got 600 then you wouldnt probably get anything more. There is nowhere on the amended return that you can claim that 600 anyway. Your return is for 2007 you got that money in 2008.

  2. Stimulus is based solely on your original tax refund not any amended returns.

  3. Too late - file the amendment, and you might get an additional refund, but it won't affect your rebate.  And married people filing a joint return get UP TO $1200, not an automatid $1200 - they get $1200 only if their tax liability was at least that much.

And if you have an ITIN and not a ss# you shouldn't have gotten a rebate in the first place, or if you spouse just has an ITIN you wouldn't have gotten it if you had filed properly.

You do realize that filling as single when you are married means that you filed an illegal return?

  4. Just a quick note - the married couple is elligible for $1200 because that accounts for each of them - $600 x 2.

You don't get a bonus for being married, sorry.  If you amend your return - you would only be able to receive an additional $600 if your wife never filed a tax return.  She may also receive her Stimulus money by filing her 2008 return in year 2009.

If you were legally married, you do still need to file an amended return 1040X.

  5. Did your spouse have qualifying income for the stimulus payment? If not, it would be worth amending your return so that you could claim the rebate for him or her. Otherwise, you should work the figures to see if it would make more sense for your spouse to file by themselves rather than filing an amended return.
