78 year old woman who's daughter has removed her from her home of 47 years and husband of 50 years. Husband thought she was spending a few days with her mother at her home. Daughter has manipulated mother to remove her money and transfer it under her care. The Mother is disabled, Bipolar disorder and COPD on oxygen. Daughter has refused other family members to see her or her grandchildren. Daughter has a firearm in the home and leaves the elder woman alone for many hours a day when she leaves for work. Daughters home is dysfunctional thinks dogs are children, Married to a man and is openly g*y? likes to defaecate in public places, witchcraft, among other things I can't mention on here and works for child protective services in NYC. The daughter has been trying to gain control over the estate and remove siblings from it. The daughter has done everything to split the husband and wife up to control the womans Social Security and estate. Anyone have suggestions for advising my friend on how to deal with this situation.

  1. REPORT HER TO THE POLICE, BUT YOU HAVE TO HAVE PROOF THAT SHE IS MISTREATING OR NEGLECTING HER MOTHER. TAKE PICTURES, VIDEO TAPE HOW LONG SHE LEAVES HER MOTHER ALONE.DAUGHTER SOUNDS LIKE SHE IS A LOONEY TUNE..

  2. If things are truly as bad as you're saying, your friend could give a call to your state's department of human services.  In some states it's called child and family services.  Either way, they can launch an investigation and if there is abuse or neglect occurring, the mother can be removed from the home.  Since the daughter works for such an agency, she may be aware of loopholes and try to use them.  Your friend will need to be very careful when reporting this to make sure that it's reported to someone in a position over the daughter and not one of her peers who might give her a heads up.  Her supervisors will also be more likely to conduct a proper investigation since they definitely won't want an abuser working for them.  Keep in mind that if the mother is of sound mind your friend may not be able to get too far with an investigation.  It's more difficult to combat an elder being taken advantage of it they are not suffering from senility or some similar age-related disorder.  In a worst case scenario, they could try contacting the attorney general's office to see if there are any charges you could bring for them taking over the estate.  Legally, unless he is incapable, the husband should have this responsibility.

  3. Your friend absolutely has to see an attorney and right away.  Preferably one who knows elder care law.

If there are crimes going on there, if the mother is being neglected, then she should also call the police and file a report. And call Social Services.  What happens to the 78 year old when she is alone?

  4. You need to get a lawyer right away before its too late.

  5. How about a lawyer?  If there is concrete proof, then you need a lawyer.  Plain & simple.

  6. You call the New York City Department for the Aging 212-442-3103.

Explain everything that you have stated here.

They will remove the woman from the house and help the family figure out how to protect the elderly person and their assets.

    Best wishes
