As an employer who is currently not hiring, is it discrimination or illegal to not give someone who walks in an application?

  1. Who cares, if they are not hiring why would you even apply?

  3. No, as you don't have any vacancies. You only are required to supply them if you do have vacancies.

  4. just tell the person, sorry we are not hiring. why would the person bother to fill out an application. If the person was a disabled black woman, best to just take the application to avaoid problems.


  5. You can merely state that you are not currently hiring, but they are more than welcome to fill out an application in case something comes up in the future.

  7. As long as you refuse to give out applications to any and all who walk in, there is no problem. IF you are at all selective about who does get them, it could become a problem.

  8. Nope. The state of California is a Right To Hire State not a Right To Work State, meaning no they do not have to give you an application just like they do not have to give you are reason why they will not hire you or why they fired you...

If you refuse to give an application to someone because of the color of their skin, their gender, or any number of other reasons that you are selective about not giving an application for, then it would be discrimination. If you are refusing to give an application to everyone that asks, that is equal treatment.
