Question:

Employer in Indiana will not let an employee take a vacation longer than a day. What recourse do I have?

I am able to take a day off but I, personally am not allowed to take more than that at any one time. Other employees have been approved for up to two weeks off in one vacation request. The reason I was given was that I had important things to do and there was no one in the office to handle my work while I was gone. I work in a small business of >50 employees.

  1. vacation is at the discretion of the employer. legally, you don't have to have any.

    you have the recourse of finding a job you like.


  2. Unless your contract states differently or you can find an ulterior motive relating to a protected class you are a member of as to why they would deny you the same benefit other employees have, you have no recourse.

  3. That is BS. He doesn't want to add your work to his. He figures that is why he hired you. I'll bet he's not shy about dumping some of his stuff on you when he goes on vacation. Stick it to the sucker, quit! You can get a job at a better staffed firm. Make sure this time that you have a relief.

  4. So there's no one under your or above you that could fill in for you while you are gone? If so, and they had already asked for vacation first, then that's why. If they're just saying you can't leave b/c no one can do your job, then you need to show your employment information to the head boss where you work and talk to them about it. Otherwise, there jprobably isn't much you can do besides find another job. Then I suppose you could sue them, but you can't really sue them and plan to continue working there. :)

  5. What is the vacation policy at your job?  You didn't post that.

    How long have you been employed there?  In MOST work places, vacation days accrue by tenor.  It sounds to me like you don't have enough tenor there.  I suspect the person who gave you the reason of "there's no one else her to do your work" simply didn't KNOW why you were denied your request, so they made one up.  The only way to solve this is to know your vacation policy, you cannot be held to standards other than what is written into the policy unless your personal contract states otherwise.  No one here on yahoo can help you, you need to go back and read what you signed when you took your job, and I suggest knowing your rights at all times with all employers.

  6. Find another job.

    If you report your employer to the labor board, you are going to be looking for another job anyway.  They will find a reason to fire you.
