Employer is ignoring doctor's note,

My husband's employer is ignoring a doctor's note stating he can not being doing manual labor (auto mechanic). Not to mention they are not allowing the required time for doctor/chiropractor appointments. The sysmtems are getting much worse (protruding discs in back), but with no consideration we have no where to turn. Isn't there anything to back up his end? I feel like they are just trying to push him til he quits, which we can NOT afford.

    Why would his employer want to pay someone who can't work.

    File for SSI disability.

  3. This is not an OSHA issue. Your husbands employer likely does not have any other job description for your husband so is in the position of either ignoring the doctors note or laying off your husband. I don't believe there are any laws that make employers find different positions for employees who can longer do what they were hired for.  

  4. If your husband is a mechanic and he cannot do manual labor, then what is he supposed to do at work? Did they say they had enough paperwork or other types of non manual work for him to do?

    If there isn't any light duty work at his job then the doctor needs to put him off of work until he is better. He can draw disability or workers comp depending on if the injury happened at work.

    If your husband ignores the doctors instructions, the company can fight the claim saying he is really not hurt. They may be taking pictures as well.

    Contact the labor board in your state right away and ask them what rights he has regarding this.

  5. Was he injured at work? If not, the business has no obligation to him at all. Sorry if this sounds harsh, but if he cannot do the work required, they could let him go. Is there a reason the job suddenly changed from manager to worker? This part could be an answer. Something is missing here.
