Employer terminates insurance but continues to take deductions?

My husband left his job a week and a half ago on August 11. We just found out that his old employer retroactively terminated our medical insurance effective July 31. We had our insurance deductions taken out on August 1 and August 15. This should have given us insurance through the end of August. Is this illegal, to terminate an employee's insurance but then still take the money out of their checks? Where can we go to get help on getting our money back from the company? Thank goodness we didn't use any medical services during this month.

  1. Once the insurance is cancelled they are no longer supposed to take any money for you for that insurance. Your husband needs to contact HR immediately to find out where your money is.


  2. It depends.  If the check you got for August 15th, paid you for work in July, or if the employer "advanced" premium for you, then they can still collect for July premium, in an August paycheck.  

    You would file a complaint with your state department of labor.  But this MIGHT have been legit - the DOL will ask the employer for which period the premium applies, and if it's for July, all you'll get is a letter, saying, this was for July premium.

  3. Its always been my understanding that your health insurance continues the rest of your last month worked. So if your husband stopped working on 8-11-08 you would be covered until 9-1-08. You should contact the insurance company and make sure that he in fact canceled the insurance because I don't think he can. If you want the money instead of the insurance for the rest of the month you need to contact the employer and say you want your money back otherwise you will be turning him in for insurance fraud or maybe small claims court.
