i was previously employed by a bus company, in 2001 i was 18 years old then

8 years on, i have re-applied for the same vacancy, attended the interview, and it cam to the interviewers attention that i was previously employed by the company, but failed probhational period and was also not good at time keeping... my question is, can they reject my application due to my previous record with the company... i mean it was 8 years ago, which is almost a decade... peole do change, i am now 26...

  5. Unfortunately they can keep this against you. Many companies will not take a chance in employing someone that failed their probation period before.

All employers are permitted to decide their own policy regarding the re-hiring of former employees.  I am a recruiter and when people leave my company, their employee file is marked with either "eligible for rehire" or "ineligible for rehire".  Then, in the future, if they want to apply to the company again, I have to check this first before I can interview them.  Any employee which had been sacked - including those who simply not completing their probation - would almost certainly be ineligible for rehire.  There is no time limit on this - you could apply 25 years from now but the outcome would be the same.

    So you may think it's unfair, but it's certainly not illegal and they're well within their rights to reject you.

  8. Of course they can reject your application. They gave you a chance once and you blew it. Why should they take a chance on you again. Yes some people do change, but there is also an old saying with a lot of truth behind it about a Leopard never changing its spots!

    The firm will only interview what they consider are the best of the applicants. if they do not consider you one of the best, you do not get interviewed. It is not unfair treatment, you are in competition with other people and you start out with a black mark against you.

  9. It depends on the country Rob, you see, in the Uk for eg, it wont matter as long as its about 5 years later and you can also reapply one yea later!

    If you have failed its five years I think!

    So its worth trying anyways.

    You deserve another chance and I am sure now you are respopnsible enough to not blow it!

    HOWEVER, based on your other posts, you really haven't changed.  So whoever did the interviewing could see that and didn't want to hire you again.


  11. You are right, time do change people, but in your case, you did not change because you applied for the same post in the same company. so you have not change at all. I think the interviewers will not hire you this time also. If you have applied for another post in the company, it will be a different matter altogether for the interviewers to consider.  

  12. Yes, an employer does have the right to not rehire someone as long as the reason is not illegal (because you are a woman, a certain religion, sexual preference). They are making a decision based on previous employment and for a business reason - failure to successfully complete your probabation period. Some companies even put a policy in place where they do not rehire former employees, regardless of their previous employment being good or bad.

    Also, on the job application did it ask you if you had been previously employed with them? Did you answer that question honestly? If you did not tell them the truth to this question then you can also be denied employment for fraud.
