End of NY lease agreement, can I just leave?

I don't have the lease in front of me, so i don't know if it has a clause. But it is up August 31, we had a received a letter last month saying we had 10 days to renew the lease, and i didn't, I thought that was sufficient. In NY (queens) can i just leave at the end of my 1 yr lease?

  2. At the end of a lease term, if you do nothing, the lease defaults to a month-to-month situation. If you plan to vacate, you must give 30 days' notice. That is, if you give the landlord notice today that you are leaving, you owe a prorated rent through September 27, even if you physically move out today.

    This provision is built into leasing/renting laws, so property owners have some time to get the place ready for and find another tenant with a minimum of lost rent. The law also states that a landlord must give a tenant on a month-to-month basis 30 days' notice to vacate. This allows a tenant time to find another place to live, without just getting thrown out in the street.

I think in most any state, by not accepting the landlords offer to renew, you are finished at the end of your lease term, Aug. 31st.  To be safe, however, I would call and also write them that you are planning on vacating on or about that date and if you have a security deposit due you, be sure to ask for it, as well.

  5. I believe you can in any state.  The end of the lease term is just that, the end.  They are just giving you an option to renew if you wish.
