Entry into the US on the VWP?

I've overstayed my VWP so far by 1day due to financial reasons and i'm quite concerned about being refused entry into the US the next time.

The I-94 (green form) is given you once on the plane , therefore allowing you to fly to the US but being allowed entry into the US depends on the Immigration officer in the US.

Is there anyone that has overstyed on their VWP and been able to use it again without no questions asked?

Or anyone that has tried to use their VWP and been refused or sent back home.

  1. You have good reason to worry. and the longer you overstay the more likely you will be refused entry the next time you try to use it. They might be willing to forgive a day or two, but not much more than that.  If that happens, you will never be elgible to use Visa Waiver again and you would have to apply for a visa of some sort to return. If you overstay on your Visa Waiver, you can also be refused a regular tourist visa, and at the very least, it makes it more difficult to get one. If you overstay by 6 months, you are no longer eligible to receive any visa for 3 years.    

    There are quite a few people who have been refused and sent back home, although how many of them will tell you here at Yahoo remains to be seen.  I think the number who have been allowed in would be a much smaller number, and probably none of them with no questions asked.

  3. do know that since 1996 the law has become extremely strict, even if you only overstayed one day,

    before 1996, one day was not considered as bad,

    An automated system, coupled with the use of Machine Readable Passports, will maintain entry and departure records of all persons coming to the U.S.

    Overstays may be barred from returning to the U.S. for three years

    Overstays may be barred from returning to the U.S. for ten years

    you would have to have some very strong circumstances, but one day for financial reason, would not stand, since you have to have a round trip flight ticket,the visa waiver must be observed,

    not sure you will get by,especially with the automated system.
