I need to evict a tenant in a rent controlled apartment. His lease is up in November. Please advice.

  1. It's probably not possible but you will only know if you consult a top-flight landlord-tenant attorney.

Look over the original contract and make sure that you are aware of all the particulars of this rental agreement...for instance first and last months security dept, written notice sent 30 days in advance etc.  Make sure you have the walk through papers that described the condition of the place when they moved in.  

  3. 1) Educate yourself , I recommend the NOLO Press guide for NY Landlords for a start. You can only evict a tenant in a Rent Controlled apartment, for a very limited number of reasons. Find an attorney that specializes in working for landlords (not tenants!) in eviction cases. If you have a legitimate reason you need to work fast as you need to get the ball rolling, before your tenant is entitled to an automatic lease renewal.

  4. Unless he stopped paying his rent you are going to have to suck it up.

    NYC is very anti-landlord, to the point of being absurd.   You should hire an eviction attorney.   I do them myself in CA, but I have fewer laws and the judges are not as bunny hugging as NYC.
