Evicting the people renting my apartment... can I?

I've had these Cubans living in my apartment for 5 months... all has been cool no late payment and now all of a sudden some Dominican friend shoed up saying I'm their friend and they went "somewhere"

I can't contact them and their first month is due

I want to change the lock so that guy can't come in... I want my money.. I can't contact them in any way and i have not been contacted by them.

he says if I come in without his permission to change the lock he will sent me to court.. what can I do?

  1. Your contract was with the Cubans so I hope they signed something which had a clause stating no sub letting. If so, boot him out as you have no contract with him.


  2. You have no rental agreement with him, there fore it is not his place. Did he sign an agreement?

  3. You'll need to have him served an eviction notice by sheriff, you can't just lock him out.  Call your sheriff and ask him how to get the ball rolling.

  4. This is how I would look at it.

    How do you KNOW he was there prior to the tenants leaving?

    You don't...call the police.  I think he's a homeless bum, friend or not.

    He'll have to prove how long he's been living there.

  6. You will need to send them a notice of eviction by registered mail, return receipt requested.  Then you will need to file a forceable detainer(I believe that is the term).  

    I had a deadbeat tenant and sent a notice of eviction, and they got out before I had to file the forceable detainer.

    You will need a lawyer to prepare the document.  I have a daughter who is a lawyer, and all she had to do is pull up the document on the computer and enter the names, etc. and print it out.  If you have to hire a lawyer, they might charge a pretty steep fee for the few minutes it takes to do it.

  8. well if you wrote up a lease then you say they violated that and you shouldnt have a problem eviciting them.  the thing is you cant evict someone and expect them to be gone the next day, my father was a rental manager and i know that evictions give the tenant 30 days to leave.

    if you didnt write a lease im sure you can still serve an eviction notice and the same thing should apply.

    i dont think you can legally change the lock yet though, you have to go through the proper channels unfortunately.
