Question:

Eviction: How many days do I have?

My parents have decided to kick me out if I don't begin paying them more money than I have. I live in Johnston County, NC and a friend told me that my mother has to give 30 days legally - family or not. Does anyone know of any sources/websites where I can view this info? Thanks SO much!

  1. Increase the amount you are paying.  It will still be cheaper than getting 1st last and security for a new place.

  2. If you are paying month-to-month, they only need to give you 7 days notice. If you are paying week-to-week, only 2 days.

  3. Your mother would have to give you a 3 day notice to pay or vacate, if you do not move she would have to file with the court and you would have about 26 days to relocate.~

  4. see nolo.com and their excellent books on the topic.

if you want to make it ugly, yes, they have to go through the entire court process.

if you are paying them, even without a written lease, then you are a tenant, and they will need to give you written notice of termination of your (verbal) month to month lease, or written notice of change of terms (more money).

You could refuse to leave, then instead of taking your rent, they can institute an eviction with the court. You could probably delay the inevitable as much as 60-90 days if you play it well, or be out in 3 days if you don't.

how about simply agreeing to find a new place asap and maintaining the peace? then they can rent the place out for more if it is the money they want?

  5. maybe it'll be cheaper to pay your parents the amount there asking because  if you move out on your own you will have way more bills like

    Rent

    electric

    phone

    cable

    internet

    renter insurance

    grocery

and some home natural gas bills
