Praise to anyone who can answer this. Our apartment complex has served us with an eviction notice because they say that my husband has a felony. Here's my two points ONE this charge was from seventeen years ago and TWO we've been living there for four years!?! Can they really evict us?

It depends on your local laws, they are allowed to do a background check when you move in and deny your application, though once your in the laws are on your side to keep you there as long as you keep making payments. Unless you signed in your lease that you agreed that you could be evicted for commiting a felony, you can't be kicked out. Laws are on your side, if you cant find anything online about the laws and they wont agree with you, time to call a lawyer!

    Though do you really want to stay there with a lanlord like that? (or office or whatever :) )


  2. I don't think they'd have any legal way to evict you if you're on a lease.  They could always choose not to renew the lease.  However, if you're month-to-month, they can give you an eviction notice at any time.

    As for them evicting because of a felony charge from 17 years ago - that's a bit odd.  It's uncommon for a landlord to do a crim check on a tenant AFTER they've been living there for as long as you have.  I'd speak to a lawyer and whatever division in your area that deals with rentals.

    You don't say why they decided to run a background check after 4 years.

    There must be more to this story.

  5. I don't really know.  You probably need to ask a lawyer.  The only thought I have is that if the lease application asked if there were any felony convictions, and you answered no, they could terminate your lease because you lied on the application.  Other than that, I don't know.

  6. It seems strange to run a criminal check on someone after they have been there for four years. I don't see how they could evict you, but they most certainly are within their rights to not renew when your lease is up.
