Eviction notice because of a swearing child? Is that legal?

My grandma is 70, and she lives in a modular home park in south east Michigan. She adopted a dead relatives child at birth and he's now 4 years old. He has a knack for picking up swear words from the older kids in the park. Parents complained, but little do they know that he's pick up the swear words from the other kids. The people in the park complained and today they sent my grandma an eviction notice.

Can someone even be evicted for having a child swear?

My grandma scolds him for swearing, but he's 4, it's not like he understands.

  1. What does her rental contract say?  It may include the prohibition of a nuisance in the park.  (Loud parties, barking dog, swearing child, etc.)

    Read the contract.

    Find out how your state handles appeals of eviction notices.  (In Texas, the landlord has to file in the Justice of the Peace court to get a writ of possession.)

    Consult your attorney, if you need to.


  2. she needs to take better care of him if he is that influenced by the other children.  

    Find your gramma another location in a hurry and look around the park and interview the owners first.  

  3. They can evict you for anything they want as long as it's not due to race, religion, creed, etc.  Many places have rules in the contracts too that too many complaints will result in eviction, but it doesn't have to be in the contract.

  4. My suspicion is that this eviction is not because the child is swearing but because your grandma is too old to supervise him and he is picking up a lot of other bad habits from those older kids as well which she either isn't aware of or won't admit are a problem.  She may be in good health and very active, but very few people are going to believe  that a woman that age can keep up with a kid of four.
