  1. LOL Been there.  You will have to find out what your local laws are.  I don't know the circumstances but when in doubt kick his *ss out first, but beware of all illegal things


  2. Depends - are you the "landlord" or the roomate that lives with the deadbeat roomy!

    If you are the landlord, you should know the lesee / lessor rental rules for your state.

    If you are the roomate, give notice - if the lease is in his name, move.

    Need to be a little more specific.

    Do a search on "eviction, state" you should find rules, regs / laws to assist you.

    the Eviction process.

    Look up Landlord /Tenant Laws ( your state) online.

    The Basic Process is this:

    Eviction Time Line*

    The number of days can vary depending on the Court's schedule and local procedure.

        Day 1: Rent due date

        Day 5: Last day to pay to avoid late fee

        Day 6: Landlord issues 5- day "pay or quit" notice

        Day 11: Landlord files Unlawful Detainer

        Day 25: Court hearing date, judgment for possession and money, last opportunity to redeem

        Day 28: Last day for tenant to move or be put out by sheriff (if immediate possession is granted)

        Day 35: Last day to file appeal

    Hopefully you opt for the "Eviction" process rather than the later...:)

    If however this person is doing something illegal,abusive, criminal or in anyway putting you or your family in danger...you can just call the police and they will advise you about what your options are.

  4. legally its easier if the tenant is violent, get a TRO, if not,

    u'll have to file papers (available online for most states) in district court costs about $85, get a friend to deliver subpoena, saves $50 by not paying the marshall or proc svr, charm the judge, get a 72 hrs to vacate order, after 3 days, keep your copy of the tenant's keys with the new locks and a screwdriver next to the door in case you need to change the locks in a hurry. local law enforcement ossifers are bound to protect you in accord with the order signed by a currently seated judge from the appropriate court.

    sadly, you can't boot the L for failure to pay if they file bankruptcy, but loudness, threats, and wanton destruction of property are among many applicable reasons.
