Ex is not paying what he agree in seperation agreement for child support - what do i do?

Husband agreed to pay childs day care in seperation agreement. Her account is in the rears. He has been paying but check he wrote was returned and its put her account behind. I'm scarred she will get kicked out of day care. Papers sent to lawyer to file an order through the court but she is on vacation this week. What do I do? I cannot afford to pay her day care along with the other bills I'm responsible for since we split. He says he's doing the best he can. But he paid her day care while we were together fine now all of a sudden its a problem. What can I do until the order is place? Can a order be rushed? I live in the state of Virginia.

  1. Simple you start to play hard ball and take him back to court.

  3. Unfortunately, no order can be "rushed". You will have to be patient and let your attorney go through the normal procedures.

    In the meantime, contact the day care and be honest with them. Let them know that it is HIM and not you! See if they will be willing to work with you until the order goes through. I would also suggest having a very frank conversation with your ex and let him know exactly what you are going to do....i.e.  get a court order and garnish his wages if need be. Maybe that will motivate him into paying.

    It's tough being a single mom and not getting the support you need from the ex. I wish you lots of luck.

  4. Your best bet here would be to deal directly with the day care center explaining all the facts and see if something cant be worked out til your attorney gets back. Your attorney will know the quickest way to get this into a Judge so its the best way right now as theres little you can do.
