Exactly what are the benefits of "salary"??

I have worked for a company for 1 year and 1 month now. In Feb. my boss moved me from hourly to salary because I was getting in lots of overtime. I was under the impression that I would not get paid for anymore overtime but, that it would balance out if I was out due to emergency that I had would still make my same amount. Is this how salary works? Today is payday and my boss informed me that I am not getting paid for being out 2 days last week due to an emergency and my son being admitted into the hospital. When I asked him about any sick or vacation days that I may could use, he told me that I had already used those up from my doctors appointments when I was pregnant over 4 months ago - even though I was not aware of that at the time. I was not even made aware that I had any sick days or vacation days until today when he told me I have used them all up and now I have none. Does this sound right or am I getting screwed (like I believe that I am)?? I feel like they are taking advantage of me because I am young. PLEASE GIVE ANY ADVICE!! I am on the verge of walking out right now. Thanks in advance!

  1. First , find another position if you have already worked for 6 months or more in this company.

    Second , when you get a new contract before quitting your current job , tell the manager that according to the contract you should be paid hourly ,and ask him to be frank with you about the vacation and holidays .

    Finally , if he/she decides not to improve , give them your quit ; they may either tell you good luck and take care ,or they will reconsider your efforts.

    (( I'm not that much experienced ,but this is what I heard to happen in such cases most of the time ))


  2. You need to start looking for a new job.

    If you had excessive O/T I can understand that they put on on salary, but only certain positions can be salary, like managers, and professionals, like accountants.  I don't know what your position is, but they may not have grounds to just move you to straight salary.

    As for your days off, you should have been notified at the beginning of your employment how many days you had for vacation and sick days. If this is a larger company and has a Human Resource department, talk to them ASAP, if this is a small company, you may not have many outlets inside.  I am not in H.R. so I don't know all the laws, but this does not sound right.

    Do yourself a favor and look for a job with a reputable company.


  3. It seems you're being taken advantage of. A company is supposed to pay an employee either hourly or salaried based on the nature of the job duties. An administrative assistant, etc is to be paid hourly while a manager is to be paid on a salaried basis. It had to do with decision-making, the tasks involved, etc. They actually do not have the right to pay you a salary simply because you work alot of hours. That isn't how it goes.

    I think you need to leave that company and go to work for someone who is willing to spell out for you how much you are being paid, whether there is any paid time off, and exactly how that works. Any company who cannot or will not is not worth working for because they'll just end up shortchanging you in the long run.

  4. The benefit of salary is that they do not have to pay you overtime.
