Expungement...getting felony cleared?

could you get a 13 year old felony expunge ....it's a drug charge

  1. Yea, you probably could, but nothing really ever goes away.If they want they can use it against you if you should ever go to court for a related offense later. It's worth a try depending on the court & a good lawyer. A lot of people think it just vanishes, but juvenile records can be used also in certain instances.


  2. Every state has it's own rules about expungement and what is allowed to be expunged. Certain conditions must be met, such as only a first time felony  can be expunged. If two or more numbers are present, they will stay for life. Most states demand 5 years free and clear of all legal encumbrances, with some states demanding 7 years.

    Best advice, since this is state specific to the charge itself, would be to contact an attorney within the jurisdiction of the arrest/conviction itself. He can tell you if you qualify. If so, he can also draw up your petition and submit to the court in your behalf.

  3. Anything is possible.  You need an attorney.  But it all depends on the charge, punishment, judge, what you've done with your life since the crime.

  4. It all depends on the jurisdiction you were charged in. At the federal level, only a pardon by the president could do it. If it was state court, in some states, you would need a pardon by the governor. In others you would need to just apply after a certain number of years has gone by.
