Question:

F-1 student married to U.S citizen?

Hi. I am currently working on OPT and my OPT expires in Dec08.My company filed for H-1 in Mar08 and it got approved.They also sent me the I-94 card.I was married to a GC holder in Apr-07 and didn't apply for me tat time as I was waiting for his citizenship.Now he has just recieved his citizenship.Also, due to some family emergency I have to leave my job.

My question is if my husband applies for me, what forms should I use to stay here and get work permit.Also, how soon do i get work permit?

Another question what happens to my H-1 once I leave the job?

And, my OPT expires in Dec08, so what are the possible things I should do saty here and work?

Please enlighten me and help if possible.

  2. Here's what you need to do.  You need to do it ASAP.

    The American spouse files I-130, I-864 and G-325A.

    The Foreign spouse files I-485, I-765 and G-325A.

    File them in the same envelope, all at the same time.

    In 90 days or less you'll get your work permit.

    In about 6 months you'll have your green card interview.

    In about a year you'll get your green card in the mail.

  3. okay - first thing you need to do is not to panic. give your husband a little breath. why are you always torturing him. poor guy........ he will take care of you and your status if he loes you. so now call him and say humpty dumpty sat on a wall. bye

  4. I'd advise listening to Yak Rider, or it may be some time before you make it back to the US. If you leave the job, you lose the OPT status, but if your husband files the forms Yak Rider has suggested, you'll get a work permit while waiting for the green card, so you'll be able to stay and work for anyone you wish who also is willing to employ you. If your husband files for you, the H-1 is irrelevant, although you could still work for them, if you like.
