F-1 student visa holder got married to a U.S. Citizen? please help.?

I am a U.S. citizen and i got married to a F-1 student visa holder few weeks ago. After we got married, my husband went back to his home country for 2 weeks to visit his family, (he goes back every summer). He will return in a week. Also he is coming back still as a F-1, because he needs to finish his studies in a university. His visa expires in 2 years. My question is will his entry be denied when coming back to the U.S. next week?

  1. It is possible. A F-1 student married to a US citizen is a definite overstay risk! You should of waited till he returned and then gotten married. You could have applied for his green card and an advanced parole. (my wife and I did this a number of years ago but it still works). Hopefully they will not check on his marital status. Good Luck!


  2. You won't have problem.

    First of all, USCIS does not require you to update change of marriage status. As soon as he is still a student in good standing, it should not be the problem.

    Secondly, you should plan to adjust your new husband's immigrant status since your husband eligible to immigrate.
