I am on my OPT (F1 student visa) and recently married a US citizen. What documents does my wife need to file? She doesnt make as much, so her parents will be sponsoring me. What documents do they need to file?

  1. This is a simple adjustment of status (AOS) package.

    Your wife needs to file the following forms:

    * I-130, Petition for Alien Relative

    * G-325A, Biometrics

    * I-864, Affidavit of Support Under

    You will need to file the following forms:

    * I-485, Application To Register Permanent Residence or Adjust Status

    * I-765, Application for Employment Authorization

    * G-325A, Biometrics.

    * I-131, Application for Travel Document.

    Her parents, if they are using BOTH of their incomes, goes like this: One parent (let's say her father), fills out an I-864 and includes his income and her mom's income on it. He needs to show proof of that. Her father also will need to provide either 1 year or 3 years of most recent tax returns.

    Then, her mom will complete an I-864A, which shows that she is a household member of her fathers, who is including her income on his I-864.

    If only one of the parent's income is going to be used then whichever parent's income is going to be used, they just need to complete an I-864.

    You should file all of the above forms together as one package, included her's, yours and her parent(s) forms.

    The total cost of this will be aroun $1,500 - budget for around $2,000.
