Question:

F-1 to J-1 or H1?

Hi, I'm in MYC, part of NYFA workshop with f1 visa. When the worlshop ends, and I decided to work in company, that will not sponsor me for H1B,how can I change my status to J-1?! also what is the best source for finding Comapnies supporting aliens. And if I decide to work for free for the company, will the chances for getting j-1 be bigger? 10x

  1. F1 is a non-immigrant visa and you cannot change to an immigrant or work visa.  A condition of your student visa is that you must return to your own country upon completing or terminating studies.

    Working for free is NOT a possibility -- any company must prove that they are paying prevailing wages in order to get a visa for an employee.  H1 visas require 2 yrs of experience beyond a university degree, so you are not qualified.

    Companies are cutting back sharply on hiring foreign workers.  The US job market is in meltdown -- over 380,000 Americans are being laid off each week.  Companies are not renewing or even cancelling work visas and terminating the employees.  In this case, the foreign worker must return home immediately.

    You must return home when the workshop ends.  You do not qualify for a J1 or H1 visa.


  2. It sounds like they are not prepared to sponsor you so if they are not prepared to hire you then look elsewhere for a job. The other post is correct.
