Im on F1 visa when I got married to my husband who is GC. He already file I-130 last March 2008 and got a letter from USCIS that they have received it. Until now, no news from them..My husband will file for his citizenship on January 2009. My questions are :

1) If he became a USC, does the I-130 will be processed faster?

2) How long will the processing of the I-130 when my husband becomes USC?

3) When are we be able to file for the I-485, I-765, and I-131? After he becomes USC or after the I-130 got approved?

Please help:)Thank you!

  1. Yes, when he becomes a US citizen you will qualify for a US immigrant visa with no quota.

As soon as he gets his US citizenship he should notify USCIS of his new status and you should file Form I-485, I-765 and G-325A with the USCIS.  You do not have to wait to hear anything about the I-130.  All you need is the case number to put on the I-485 and I-765 so they can match them up.

You will get a US work permit within 90 days.

You'll have your green card interview in about 6 months.

You'll get your green card in the mail in about a year.
