Question:

F1 visa holder marrying a US citizen.?

Hi. Im an F1 visa holder going to college in the US for two years. and every summer I go back to home during the vacation.

I am marrying an US citizen soon. but we both worried about my status after marriage.

I'm aware that I need to file I-485, I-765, G-325A, and I-131, and my girl needs to file I-130,G-325A,and I-864

Ok, Here are my questions.

1) Since I dont have K-1 visa, Is there any form that I need to file, besides ones listed above?

2) I'm on F-1 visa, not K-1. may any problem arise?

3) I cannot afford lawers, is there any alternative to ask questions?

  1. You have to exit on a F-1 and return on a K-1

    any other method may get you barred.

  2. This is something really important. If you cannot figure out the rules yourself, you have to hire a lawyer anyway.

  3. You listed the forms that are needed very well. Just do not depart the U.S. without the Advanced Parole form which is what the I-131 application is for.

    The alternative to an attorney is the CIS toll free help number.

  4. 1) Don't forget Form I-693, which you the USCIS doctor should already have. You will need to file this along with the I-485.

    Also you will need a police clearance form from every country you have lived in for 6 months or more. This is required for Form I-485 also.

    2) No problems, but as Fred stated, don't leave the country until you have the green card in hand, since you will be considered to have abandoned your adjustment of status.

    3) There is the help line which Fred mentioned, but they can be quite vague and they are known for giving misinformation which they are not liable for should there be a mistake. There are many immigration forums out there to help.

  5. 1) The form I-485 is called Register to Permanent Resident or Adjustment of Status, meaning you are applying to get your status adjusted from F1 to PR.

    2) No problem at all, although you need to show USCIS on going relationship to prove that your married is bona fide.

    3) If you don't have any major issues, such as out of status or arrests or convictions, lawyer is not necessary.  Try this site, it would be helpful.
