FALSE ARREST DO TO FALSE ALLEGATIONS?

My brother beat me up so i called the cops and lied and said he had a knife and chased me in the freeway when he didnt just to get him arrested for beating me up now he has been in jail for a week and tomorrow is his court dat for a settlement? Should i go and speak with his public defender before the case..??and will i get arrested for false allegations?

  1. the best thing you can do is tell the truth no matter the consequences. Your bro still committed assault and battery whcih is a serious crime and he'll likely still be punished.  But I'm sure you don't want him tried for something worse like attempted murder.  


  2. What you did was not only foolish but wrong. They certainly would have arrested him for beating you up without your having to lie about it. Now you must go and undo the injustice you committed, and once you tell them he didn't really chase you with a knife, they won't believe you about the beating either. Now you can only choose between continuing to testify falsely against him, which will double the harm you have done, or telling the truth, and having to take the consequences for the harm you have done. Plus when he gets out he will be angrier than ever at you. I would say you are in deep trouble either way.

  3. You've gotta do the right thing here, no matter what, and no matter how much you might dislike your brother, or how much you're afraid of the consequences of doing so. You may get fined for false testimony, but the consequences wouldn't be that bad- certainly not as bad as the consequences for attempted murder that they'd give your brother if you don't speak up. I promise you, you will not be punished harshly. Besides, he did beat you up, so he should face assault charges, but even then, if you want to show him forgiveness, then drop all the charges, and deal with it on a personal level, instead of handing him over to the prison system. Personally, I think it would be best for your family if you dropped all the charges and had him set free. It would be very noble of you, and may even save his life. Then have your parents kick him out of the house for beating you, but don't bring the courts into it. Keep it in the family. You will destroy his life, if you don't do the right thing, and you will have to live with the fact that you destroyed his life, and got him sent to prison for years, where will most likely be raped, beaten, and possibly murdered. If he's raped, I guarantee you he will commit suicide. I had a friend who did. Just do the right thing, kiddo.

  4. It doesn't matter if you get arrested.  You are possibly going to be putting your brother in jail for attempted murder and assault with a deadly weapon, both carry heavy prison sentences.  

  5. You can be charged for Obstruction of Justice. (aka Lying to the police) IF you tell the truth now, he won't have to sit in jail anymore and you should feel better about that. IF you don't have any priors on your record you will probably just get a probationary period or Community service and will have to pay your brother restitution. If he missed work you will have to pay for that time. IF he lost his job, you can be arrested for Slander or if you wrote a statement stating this. it would be considered libel and he can sue you in civil court.  Goooood luck
