The FIR registered against Australian batsman http://www.senore.com/Cricket/Luke-Pomersbach-c1856, which led to his arrest on charges of molestation and physical violence, was quashed by the Delhi High Court today on Friday, as both parties involved agreed to reach an out-of-court settlement
and expressed the desire to leave http://www.senore.com/Cricket/India-c750.
“Since they have resolved the dispute and want to go back to their respective countries, I quash the FIR,” said Justice M.L. Mehta.
The incident occurred earlier this month when Pomersbach was accused of having molested US national Zohal Hamid at the Maurya Sheraton in Delhi, in addition to physically assaulting her fiancé when he requested the cricketer to leave.
The 27-year-old was taken into police custody and charged under sections 323 (hurt), 354 (Assault or criminal force to woman with intent to outrage her modesty), 454 (house-trespass or house-breaking), and 511 (Punishment for attempting to commit offences
punishable with imprisonment for life or other imprisonment) of the Indian Penal Code (IPC). In addition, he was also suspended from the Royal Challengers Bangalore – the IPL franchise with which he has been affiliated.

The court overruled the objections of the Delhi government, which opposed the move to dismiss the case and allow an out-of-court settlement.
