The 1st answer is that which  conferred power to the national Government, it is called delegated powers, while limiting the powers of the state and the national government. We have what is called a limited government. Some of the powers are given to the national Government only, this is called exclusive powers. Some examples

  1. coin money            

  2. make treaties with other countries.  

  3. regulate interstate trade

  4. declare war/make peace

  5. weights and measurements

   check Article 1 section 8 for a more complete list.

2. 2nd question---The Gideon case said the accused must

     be offered a lawyer/counsel at the time they are arrested,

     before they are question. Miranda Rule/what they have to read to a person when they are arrested... you have the right to an attorney-if you cannot afford one one will be provided.
