Question:

FS-240 For a baby born abroad do both parents have to be U.S. citizens?

I am a U.S. Citizen (born there) But my wife is not. We just sent off her I-130 today... But we are concerned if she gets pregnant... Can we still apply for the FS-240 or what needs to happen.

Please serious answers only and those who know what they are talking about.

  1. Yes, the kid will be a citizen, if there's a kid that is.  As long as you lived in the US at least 5 years, 2 of which were after the age of 14.

    If you did NOT live in the US for 5 years, 2 of which are after the age of 14 the kid will not be a US citizen.  You are not eligible to pass your citizenship onto the child.

    You know, a Depo-Provera shot every 3 months will easily prevent pregnancy and thus avoid problems until you are both settled in the USA.
