Fail to Use Due Care In An Accident ???

I was involved in an accident 2 days ago. The guy in front of me stopped i stopped but the guy behind me didn't stop he rammed his car into mine causing my to hit the guy in front of me. The cop came and said it was my fault and i was the only one ticketed for fail to use to care. resulting in a crash. The guy behind me faults himself 100% he said he knew he was speeding and going to fast and no paying attention. HE GOT NO TICKETS. My car is basicly totaled. I already made an insurance claim with the vehicle that crashed into me. I've already called him he blamed himself already. My question is since i was the only one who got a ticket for fail to use due care will the other guys insurance pay for my vehicle damage ? thanks in advance.

  2. Go to the police station where the officer that wrote the report & the ticket works out of. and pay for a copy of the police report. If they have it ready they will print one for you, if it is not ready they will tell you when to come pick it up. If it is ready or when you have it, ask to speak to the traffic supervisor. Go over the report with him / her. The report will tell you the officers version. The insurance company you made the claim against will have a copy of the police report,what the see will determine whether or not they will pay for your damages or make a claim against your insurance company for repair of their insured's vehicle.
