Question:

Failed my road test, the examiner yelled at me, is that allowed?

I am 29 (long story short, I never went for a license until now), well, I have been practicing a lot, done the parallel parking, 3 point turn, all perfectly. I was a little nervous when I got to the test. Right away the examiner was rude, told me he wanted to see the cars registration and when I went to hand it to him, he says "what the h**l, put that away!" Which confused me. Then he tells me to pull away from the curb and start the test. Right away, every move I made, he would laugh really loudly and shake his head. I stopped at a stop sign and looked in both directions, and behind me, etc. then began to turn. He then tells me I just ran a stop sign when I know I did not. It was making me upset the way he was acting. Then, he had me parallel park. I signaled, pulled up to the car, backed in (while turning my head and looking out the back window) once I was in the space, I put on the brake, and put it in drive to straighten out. The guy yells, "bam, you would have just got hit in the ***!" He said because I should have been looking out my back window when I was pulling forward to straighten the car. I was supposed to look behind me while I was pulling forward???? Then during the 3 point turn I did it exactly the way the NY drivers manual states to do it, he started yelling at me saying, "who the h**l taught you to drive? You don't have to go into the left lane during a 3 point turn!". I didn't think they were allowed to yell and swear like that, is that legal? Of course it is my word against his and the DMV will just think I am pissed I failed if I report him. But I DID do everything right and he told me I didn't do even one thing right. I did start getting nervous when really started yelling and cursing at me. This is the only guy that does the road tests, so I am not sure I want to even try it again with him. I don't want to read comments saying I must have done everything wrong. I know I didn't, I have been driving for a long time and also had a professional approved by the DMV teach me how to drive. Oh, and then the guy, at the end, tells me to pull over and park and point to a place that would block a driveway. I hessitated and told him it was a driveway and he says, "forget what the book says, you better not be arguing with me." Does any of this sound normal to you? This was my first time taking a road test, so idk if that is how it is all the time.

If I were you, I would type a complaint and have it notarized.  If that is the only person that does tests where you are, I would go back but this time I would take a tape recorder and possibly even a hidden camera.  After the test, turn in the complaint (whether you pass or fail) and, if he was acting inappropriately the second time, turn in the audio or video as well.

    If you passed, you need not worry about him anymore but you should still turn in the complaint.  If you fail, you now have proof of his behavior.

    You can go to any DMV in your state, however.  It need not be your local one.  That would be another option, perhaps better for you but I would want to get justice.

    I do wish you the best the next time you take the test, whether it is there or elsewhere.  no, it is not how it is all the time.

    My advice to you is you should report and make a complaint to the DMV. Usually an examiner is NOT suppose to tell you anything. They usually just score what you do right or wrong. Now the next time you take the driver's test, have someone watch you do it or have someone record it like your parents or a friend. You can also wear a jacket or something and have a hidden microphone in there to record what happens in the car.

    Also as I mentioned before, an examiner is not suppose to say or tell you that you're doing something wrong (unless you put yourself or the examiner in danger); the description "examiner" is self explanitory. Now as your parallel parking and 3 point turn, it doesn't matter what you're doing right or wrong; make sure you do the basic requirements. What matters is that if you get it done in the given amount of time or not.

    Now what you need to do is file a complaint regarding the examiner. I would suggest that you have proof first (such as voice recording while testing, etc.) . I would also suggest that you go to a different DMV. It shouldn't matter how far it is, but if you believe you are ready for the exam, then go for it. It's better to get what you earned other than have someone take that away. Make sure that when you file this complaint; say that the examiner was rude and interefered with the test. He told me what I did wrong and make it clear that you would not recommend this DMV to anybody.

  4. Sounds to me like he may need some checking-out. Is there another DMV in the general area that you could test at instead? With a DIFFERENT examiner?

    When I took my driving test two years ago (California), the examiner only asked to check the headlights, turn signals, etc, then kept quiet, only giving directions while I was driving. This guy seems extremely argumentative and even abusive. If possible, see if you can talk to someone at the DMV (higher up than he is) and explain your situation. If that doesn't fix anything, honestly see if you can find another DMV in your surrounding area that you could test at.
