  1. Well, I wouldn't say that you couldn't see because of the car ahead of you - that means that you were following too closely, which is another ticket.

  2. Many states have laws that say you must move over or slow down under a certain speed when there is a police car on the shoulder.  If you didn't do this, then you're guilty.

  3. Go and explain that to the judge and if he or she believes you, maybe they will drop it. But, the way the courts are now a days, they need all the money they can get, so you most likely will have to pay. Maybe they will just reduce the charge with no points and make you pay the fine. At least you won't have any points. Or, you can do some time in jail if you don't want to pay.

    Well, did you pull out of the lane closest to him? If not, you have no basis to be not guilty.

    You obviously had room to pull over, that's why you received a summons.

    Many states are passing laws that you can not pass a emergency vehicle in the lane immediately adjacent to them.

    We are tired of getting run over by idiots who can't drive.

Most states require drivers to merge into the left lane when there is an emergency vehicle on the shoulder with the emergency lights activated.  Failure to do this is an infraction.  Therefor, you will not be arrested for the commission of the infraction.  If you fail to appear in a court proceeding, the judge may decide to issue a warrant for your arrest.  This is the only way you can be arrested during an infraction case.  I usually do not give legal advice.  However, If you want to get it over with, just pay the ticket.  I am unfamiliar with Michigan laws.  So, I'm not sure if you will have to appear in court or not.  You can call the court that you have been ordered to appear in.  Ask them if you can just pay the ticket and move on.  This way you save on court costs.  If you do have to go to court, you should probably plead guilty and ask for forgiveness from the court.  Judges usually show leniency with first offenders.

    People did not pull over. Maybe, just maybe if given the

    chance, he would have lived had we gotten to the hospital

    sooner.  He passed away in the emergency room.

    Took us 20 minutes for a 5 mile ride.
