Failure to yield to oncoming traffic in Champaign,IL?

I was turning right from a private drive into the main road...The sun was hitting my eyes and was almost blinding me. I did not yield to an oncoming police car going straight on the main road due to the sun. Is this worth contesting not guilty? The policewoman took my license as bond but said I could drive without it. If I plead not guilty can I get my license back before trial?

  1. Failure to yeild is your violation. You can go to court and explain the sun part...............but it won't work.............

    You will get your license back when you go to court, AFTER you pay your fine...................


  2. well.. just because the sun was in your face... doesnt mean you should get away with the fact that you did it.  if you gave him your reason for pulling out in front of him and telling him that you did it because the sun was in your eyes... that is a perfect admission to guilt to add to his notes when it goes to trial.. you would be better off to pay the ticket or take some sort of deal because if it goes to trian and you are found guilty... your punishment might be worse.

  3. Your defense is not considered valid, but I would not recommend what you do with your case.

    You can drive with the complaint until you get your license back - but if you need the actual plastic before the court date, you can go to the court - 10 days after the issuance of the ticket - and post money in stead of the license for up to 10 days before the court date.  But read the ticket and paperwork given to you by the officer- it should explain this.
