Question:

Fake death to avoid getting sued by creditors???

My buddy wants me to tell his creditors that are gonna sue him for his debt that he is "no longer with us", what do you think any recomendations for him to get rid of them? or does he just gotta wait the statute of limitations?

  1. Thanks for the laugh, HelpMeEscrowStuff!  Getting tossed in prison for lying to a collection agent!  Wow!!!

    I can see it now....sitting on a bench with murderers, rapists, drug pushers......and they ask me "what did you do?"......

    "I lied to a collection agent!"

    Brings back memories of "Alice's Restaurant" for any of you baby boomers out there, doesn't it?

    Anyway, it's a swell idea.  But they've heard this excuse a billion times and they won't fall for it.


  2. It would take more than you just telling them that.  They would need a death certificate to discharge the debts, and they would only do that after they sued his estate to recover as much as they could.

    He should probably consider bankruptcy is his situation that bad- its a lot more likely to help him out than just having his buddy tell someone that he died.  Do you guys really think that they are that stupid, or that someone else has never tried it before?

  3. You would be committing a crime. I suggest that your friend is NOT your friend. What he is suggesting that you do can/will land YOU in prison.

    As the other answerers have said... they will need a death certificate anyway. Know of a good way to fake that? Probably not... and if you did, that's a felony, so don't even try it.

    As to the "Statute of limitations".... he owes the money and needs to pay it. The Statute of limitations refers to how long they can keep it on his credit report and how long they have to sue him for the $$. But once he is sued and LOSES, he owes the money immediately. If he doesn't pay, he is *always* obligated to pay.

I totally agree with bmwdriver, that is so crazy.  At this point, it would seem that bk would be the obvious way out, but you should talk to a credit counselor or a lawyer before you take my advice.  But, like he said, they are not going to stop harassing you, your landlord, your friends, your family or anyone else they can find, that knows you.  This is what they do for a living.  You should just face up, and figure out what you are going to do, and then once you get out of this, learn from this experience and never do it again.
