Family renting our house 4 yrs. Now we want to return. nice family but need a good letter to send.

They have been renting month to month. Just a lease agreement the 1st yr. We told them we would like to be back into the property by Nov. This was just an FYI in late May. Does a letter dated 8-15 asking to be in Oct. 31 sound reasonable?

  1. When is the lease up? If the relationship has been cordial and professional I'd give them a few months notice. Simply say that "Effective November 1, 2008 we will be reclaiming the house. We appreciate the relationship we have had these years, but circumstances have changed and we need the house back. On or before that day we will be doing a Move-Out Inspection and invite you to be there for it. We will be giving you a final written inspection report and appropriate refund of deposit as provided by law. Thank you."

    Don't go into details that are none of their business. Simply reclaim the property.


  2. Sure. you are giving them more than the required 30 day notice.

  3. You owe them 30 days notice and no explanation at all. So yes, that sounds reasonable.

Just tell them the truth.  Give them as much notice as possible and make sure it is delivered.  You can warn them that you are following up with a registered letter because your Uncle (that's me) said you had to.  If they say they never received your letter, they don't have to leave.  A registered letter can not be argued with later. /

  5. Basically, thank them for renting your home and taking care of your place. Let, them know how much you appreciate them as tenants - further let them know that you will be returning to your home to live in and let them know the time frame they have to look for a residence. Since, they were good tenants based on the implication above - give them ample time to move if at all possible. Don't just rush them out - in 4 yrs you tend to accumulate and acclimate - give them time to get everything together and move in a reasonable manner.
