  1. The amount of damage caused to the property determines if it is a felony or a misdemeanor.  Every state is different on the amounts they set.  In Texas, the determining amount is $1500

  2. When you destroy, damage, or in the case of graffiti, deface property without the owner's permission then it is a crime of vandalism and it depends on the amount of the graffitti and the state you are in that determines whether it is a midemeanor or a felony.  For example in california, if the amount of damage is less than $400 and your first offense than its a misdemeanor, over $400 and you have prior offenses that it is a felony.  It could also be a felony if the graffitti describes any hate speech which makes it a hate crime which is a felony.  Check out your state laws, or your local laws to figure out how it affects in your area.

  3. I assume you meant he wrote graffiti on the school?  If so, that is a misdemeanor.
