Felony probation violation Alabama. Left State. What will be the sentence.

My fiance left Alabama while on felony probation. He was given 2 years probation for felony assault. He left Alabama and came to Kentucky and almost 4 months later the KSP came a picked him up at my home in Kentucky. He is being extradited back to Alabama. Can and will his sentence be higher than the 2 years given on probation.

  1. It depends on how much executed time was suspended.  If it was 2 years, then he could up to that amount of time, no more than that.  But if he was charged with a seperate crime like Escape, for example, he would be sentenced on that crime as well.  


  2. When you violate a court order like probation or community service, that order may well be replaced by a custodial sentence. Yes it can be higher because he is in violation the original order can be replaced and as such a new award given, will all depend on the judge and the reasons your fiance puts up, violating an order is a new charge

  3. It really does depend on the lawyer he gets, how many they have in the jail now, how they are doing financially, etc, etc.  They may just give him an early release or cut down the time on his sentence.

    You never know.

    But I can relate to your dedication.

  4. Normally, the court will sentence a person, say, to 5 years in prison, probated 2 years.

    If that be the case, he'll do the whole 5 years of the original sentence, even if he was on his last week of probation.

    Not a smart move at all.

  5. he will serve out the full sentence of 2 years no probation. more if the judge is in a bad mood. that was pretty stupid of him.
