  1. normally both parties allow 1 1/2 feet on their own sides which allows for a 3 foo gap in between for maintenance......if you put your fence at the 1 1/2foot  mark and he decides to "steal" some land by putting his on the line or closer to yours,,, his fence is then own your property and you can do as you want with it!!!!!!!!!


  2. First thing you need to be sure of is your property lines.the second thing is you will probably have to have a permit,so go to your city building in you town that is the best place to get the correct answer,

  3. In a way, you have answered your own question.  All Cities and COunties are different in these respects.

    General guidelines:

    Hedges and trees and plantings:  That is generally between you and the neighbor.  Remember that if you plant it on the line half of the plant belongs to the neighbor.   If it is on your side of the line but grows OVER the line over time.. that part over the line belongs to the neighbor.  This can make cutting or pruning or maintanence a real pain.

    Fences.. same thing.. but you may have to get a permit to build it from the local agency.  That means if you put it on the property line.. half of the fence belongs to the neighbor.  He/She can paint it, hang things on it, hit tennis balls against it, etc...So, if you can not agree with the neighbor in advance about this sort of thing then you  are better to build the fence about 6" inside your boundary and then send the neighbor a registered letter telling him where the fence is and that you are not giving up any rights to your property which might be on his side of the fence.  This will CYA when one of you sells the property and you get a third party that expects the fence to be on the line.
