Fiance Visa Waiting 4mths for approval?

My husband interviewed on May10, and status is still pending per Embassy in Berne, Switzerland. I am going for major surgery on Sept 7 and had hoped he would have gotten his visa by now. They do not answer emails or faxes, I feel hopeless and lost, what else can i do??

  1. Be patient, the embassy could have a long time verifying the documents that you submitted.


  2. Visit your Congressman's local office and speak with a case worker.  This won't assist you in getting the visa issued but the Congressman's office can force the embassy to provide the status of your case.

  3. Could take up to a year, although most cases it takes around 8 months

  4. If he was already interviewed, it means that your petition was successfully approved, and most likely the delay is because of the pending security clearances.

    What he was told at the conclusion of his interview? Was he approved or denied? If he was not denied, but told to "wait", then it is likely because of pending security clearances.

    You cannot do anything to expedite it IF clearances/name checks, etc did not clear yet. Normally, it does not take that long for people from EU who do not have prior convictions, arrests, etc. Hopefully, eventually he will get his visa and will join you in the USA.

  6. I assume you meant "fiancée" and not "husband" since you say you're waiting for your "fiancé visa..."

    Your situation is a bit confusing...

    1.  At the K-1 interview, in most instances, the consulate officials *tell the visa applicant:  

         a.  If their visa was approved or not

        OR

         b.  How soon they will learn (and by what method) whether their visa was approved or not

    What did the officials say to your fiancée at the conclusion of the interview?  

    Did they say he is denied?  If so, did they say he's eligible for an I-601 waiver?

    What did they tell him?

    * Please note that if your fiancee visa is denied, the worst thing you can do is get married, forget about the K-1 application, and just apply for the marriage visa instead.  If you do, your K-3 visa will also be denied.
