Question:

Fiance Visa: Worth it or should I just marry her?

I am an American. She is Brazilian. As much as I love Brazil, I can't make a decent living as a teacher the way I can in the States. For this reason, I have convinced her to move with me back to the US.

The dilemma: Although we both know that marriage is inevitable, I would really like to hold off marrying her until she can meet my family.

The question: How LONG will it take to file for and see through to completion, the fiancee visa? How MUCH MONEY should it be? I have already done some research but have seen many different answers. Would it just be easier to marry? Help!!

  3. It's not terribly complicated or particularly legal in nature. The real question is what's the fastest way to get the love of your life to the US so you both can live happily ever after? You can't file a fiancee petition in Brazil, you'd have to go back to the US to do that. If you go that route, you'll end up waiting up to a year for everything to go through USCIS and then back down to the consulate in Rio.

    On the other hand, if you are living and working in Brazil, if you marry there you can file an immigrant visa petition for your wife directly in Rio. This is from the embassy website,

    Filing an immigrant visa petition (I-130) is the first step in the immigration process. If you are an US citizen residing in Brazil, you can file a petition for an immigrant visa for your Brazilian spouse, parent (if you are over 21 years of age), or child under 21 years old.

    If you do it this way, you'll save a tremendous amount of time as opposed to filing either a fiancee petition or an immigrant petition for her in the US, at least 6 months, maybe more.

  5. So, she can't get a visitor visa to go visit your family, then return to Brazil to get married?

    If she visits the US and your family doesn't like her, are you still going to marry her?

    Marry her if you want too now. Then petition for her to go back with you.
