im goin to petition my fiancee.will the uscis recognize the presumtion of death that she filed for her husband that has been granted by the court?Will they questioned my birth certificate for not having the fathers name in it?im an american born cetizen.any advice can be helpfull.thanks.

  1. If she's from the Philippines, where there's no divorce, it's HIGHLY unlikely the US embassy will recognize the presumption of death.

    She will need either a NOMAR (Certificate of no marriage) issued by the NSO or an actual death certificate for her husband issued by NSO.  The US embassy is unlikely to accept anything else.

    Your birth certificate should be fine as long as it's a certified copy issued by the state.


  2. Yak Rider is correct. In the Philippines, since no divorce is available and getting an annulment is difficult and doesn't always work, declaring someone dead is frequently used as the best available substitute. Even officially issued death certificates are frequently investigated by the Fraud Prevention office as the embassy has seen more than a few of those where the report of death proved to be "premature."
