Fiancee sitting in jail..what is the outcome?

my fiancee got arrested thrusday..he turned himself in after getting a warrant for probation of violation(driving while license suspended) he did not get a bond and his next court date is in 5 weeks so he has to sit in jail..he is charged with v.o.p. and felony habituial driving while license suspended...no D.U.I's ever!!! what is the likely hood of his sentence in 5 weeks? ROR, bail, time served? please help...

  1. Okay, no DUI, just what was his license suspended for?  Habitual?  Sounds like he can't learn from his mistakes.  Dump him, he will obviously be unemployed by the time he gets out.

  3. I suppose nobody can say as there are too many variables. Whatever sentence that was previously suspended before probation can be reinstated.

    If the suspended license was a seperate thing and he is a cureent suspension period all that was suspended in court can be reinstated. Meaning that if a judge said you are say suspended for a year and get caught during that time...... not if it is just still suspended past that point and he never got reinstated and paid his fines.

    The parole violation can go both ways. But that means a judge is not going to trust him to not do so again with probation on the other charge.

    What I would be most concerned about would be the habitual driving. Where I live you don't have to get a DUI but just any combination of 3 driving on suspended or recless driving within 7 years. The felony has a manditory minimum sentence (not 5 weeks) and a manditory revocation of license for 10 years. That would be problematic for a guy who needs to drive for a living.

    That he turned himself in so that's good. That he has a wife and 2 children is good as well. So it is not all doom and gloom.

    You need to hire him a spanking good lawyer. Borrow it or sell his car if you have to.  

  4. well if he violated his probation he will sit in jail until his court date unless the jail gets over crowded then he could be released on overcrowding. You cant count on that for him to get out. As far as the outcome, it is possible that he will have to do all of his time in jail. If the offensee committed was a minor offence he may be released and put back on probation. It really depends on the crime, the probation officer, the judge, and how he has acted while on probation..
