Question:

Fighting Speeding Tickets In Lancaster California?

I got a ticket for driving over 100 mph. This is a two point ticket and comes with a mandatory 30 day licence suspension. I pleaded not guilty in the arrangment on the long shot that the officer will not show up to court.

In Lancaster California, will I have an opportunity to plea bargin with a prosecuter or will I have to deal directly with the judge? My intent is to ask for reduction of the charges down from reckless driving based on the fact that for 45 years I have otherwise been a model citizen.

  1. more info would be helpfull did they get you with radar or Lazar it makes all the difference

  2. This is an arrestable offense. Technically you are under arrest with the ticket...

It is important to know what the CVC section you were cited for and how you were apprehended.

I would discuss with an attorney and get the best from one who has experience in this field and, from this area who knows the judges...Then decide the course of action...

I've won in court with several pages of legal pages filled with questions on both sides but not for doing 100+

  3. You call the attorney's office and arrange for them to take your case. Make sure it's one of the big ticket guys in the area (there are usually 2-3). You fax them the ticket, and pay between $100-$150, usually around half the cost of the ticket.

Eventually, when your ticket is adjudicated with the city or county attorney's office, your attorney settles your ticket along with a whole batch of others for a percentage of the full fine amount--but with the provision that the ticket stays off your driving record.

The city/county attorney is usually willing to deal because the attorney you hired has such a huge volume of pending tickets, that he can really stop up the system if he suddenly insists on a jury trial for each ticket.

It's a win for the county or city because they get a fee but don't actually have to go to court. It's a win for the attorney who made a few bucks (these ticket attorneys work entirely by volume). It's sort of a win for you because you got the ticket off your record for less than face value, but I guess you still have to pay something.

  4. Unless they have started electing a different class of Judge, no bargaining.  There will be no prosecutor unless you insist on a trial.  The officer will show up for a 100-mph ticket, his friends and family use those roads too.  If you go for atrial, you will lose after making your attorney rich.  Pay the ticket and take your medicine.  You may just have to pay for taxi cabs for awhile.
