Fighting T-Mobile about a cancellation fee!?

OK....so in June of last year i went into a T-Mobile dealer and signed up for a year contract and paid $100 for a phone. Fast forward to a year later and when i switched over to verizon....I was hit with a $200 cancellation fee. Well After numerous calls....I am being told I signed up for a 2-year contract (I specifically told the dealer that I did NOT want a 2-year contract...hence paying near or full price for the phone). So luckily I have a copy of the contract that i DID NOT sign. So i faxed this in......2xs....and they still want me to pay. What is my next step? I signed no contract....I have this proof. I know Sprint just lost a lawsuit for this sort of thing. Do I contact a lawyer....join a class-action lawsuit...or contact the Better Business Bureau. I have wasted countless hours on the phone with T-Mobile....time I would rather spend with my kids. Can I sue for some cash...or should I just get the fee removed somehow...and how do I evevate this?

  1. If you have proof that you did not sign the contract and they still won't take off the fee, I would talk to a lawyer..


  2. Contacting the Better Business Bureau is the fastest way to get T-Mobile's Executive Customer Relations to investigate; that's the most likely way to get the $200 back.

    Does the paperwork you have really show that you only had a one-year contract? It's weird that they wouldn't honor that. (It's irrelevant whether your signature is on it; most T-Mobile contracts are verbal contracts. People who sign up in stores aren't on a different contract type than people who sign up by phone, if you see what I mean.)

    Also, have you also shown the price you paid for the phone? Like, the receipt or credit card statement? If the store sold you a phone at full price and then signed you up on a two-year contract, that could help show that it's the store that's screwed you here; T-Mobile's phone reps don't necessarily have access to the price you paid for the handset itself if you bought it in-store.
