Question:

Fighting my deportation since 2005... what should I do?

I was an international student,I was going to get marry my wife in feb 2006 but immigration started looking for me in dec 2005 cos i went out of status. I got scared and I left our appt for almost a month without a trace, I let my wife know before leaving but didn't tell her where I was going. I returned after a month got and got married first then I turned myself in with the Immigration.They made me sign the deportation paper and detained me for 10 days. I cameout andmy attorney filled I130 and the rest of paperwork for the green card.Case been goingon for quite a while and the interview went quite fine but they said to send us some extra paperwork(I provided them from A to Z)which we did and get no positive responce and denied it.On the other hand the case with immigration judge decided to give me the deportation cos immigration didn't approve my case.I filled I130 again with different attorney and still no positive response. We love each other very much and don't know what to do?

  2. I had much similar situation. Please have your wife contact her congress person they will help you in the process.

    I am sure you are sincere, but you must understand that many marry just for a green card, and Americans will marry for a fee.

A quicky marriage like that sounds like marriage fraud in their eyes, and you did commit a crime by not going home when yur student visa was up.  Sounds like the only thing to do would be to bring your wife to your country and live there for the 10 year ban period, and then apply to come back here.  Rules are meant to be followed, not abused, as you have done.

    When you married without status strike two

    Ignoring the order to self deport strike three

    In America when you reach strike three...you're out.

    Return to your own country with your wife and live your life with this behind you. Don't break the law again
