Filing I-130 CR-1 route?

I am currently in the process of filing the I-130 application for my newlywed wife from Ireland, she will be leaving end of the month to deal with some stuff back home.

Anyway in filing the I-130 application (whilst she is still here) is it in anyway possible for the beneficiary (my wife) to file the DS-230 part 1 and 2 does she really have to wait for the service packet 3 to be sent to her to file, could it not be done altogether with I-130 application?

And roughly for the timeline is it too much in hoping that she will be here (if things go smoothly) this time next year?

  1. I'm not quite sure about the DS-230.  I know she doesn't have to wait the year to file it....but....

    Would it not make more sense to file her I-130 with her I-485 (change of status) then get the AP (approved parole) for her to return to Ireland to take care of what she needs to do and then return immediately to the US?  Unless..what she needs to take care of is months and months.  

    If you file the I-130 after she returns home and wait for consular interviews, etc....it normally takes about 1 1/2 yrs.


  2. To be quite honest, I'm not too sure about whether or not you would have to wait. I would think you'd have to wait. The best people to ask about that would be either an immigration attorney or the immigration representative you'll be working with. Also, check out www.uscis.gov to find out more about the immigration process.

    I do know, however, that it is very possible she will NOT be here this time next year. I say that because I know someone who had an attorney and the process still took a year and a half. It has been nearly THREE years for another couple who is doing it all on their own.
